EU ICS2 new regulations fully implemented

The European Union has officially upgraded its import safety supervision system. The long-awaited ICS2 (Import Control System 2) regulation will take full mandatory effect on September 30, 2026, marking the end of the transitional period for EU import declaration compliance. Major ocean carriers have updated their operational rules, and Maersk has formally issued a strict “No MRN, No Load” enforcement policy, establishing new compliance standards for all China-EU cross-border supply chain operations.

The new regulation covers all sea cargo with zero exemption, including goods with final destinations within EU member states and all transit cargo passing through EU ports. All commodities, whether general cargo or chemical products, must complete the ENS (Entry Summary Declaration) procedure and obtain a valid MRN (Movement Reference Number) before loading. The MRN has become an indispensable prerequisite for vessel stowage, port release and customs clearance.

According to official carrier requirements, shippers and forwarders must complete ICS2 declaration and acquire a valid MRN at least 24 hours before vessel arrival at the loading port. Shipments without valid MRN, expired MRN or incorrect declaration data will be rejected for loading and rolled over to subsequent voyages. Different from the previous lenient supervision mode, the upgraded ICS2 system realizes full-data cross-verification. All cargo information, including product name, specifications, consignee and consignor details, must be completely consistent with customs documents and manifest data. Any misdeclaration, omission or concealed declaration will trigger EU customs risk alerts.

Non-compliance will cause severe supply chain disruptions and economic losses. Apart from cargo roll-over and schedule delays, inconsistent or missing declarations will lead to port detention, mandatory inspections and heavy fines at EU destinations. Additional costs such as container detention charges, port storage fees and handling fees will be incurred. Severe violations will downgrade enterprises’ customs credit ratings, resulting in long-term intensive inspections for future EU shipments.

The ICS2 upgrade is a key measure for the EU to strengthen border safety supervision and standardize international trade. It builds a full-cycle supervision system including pre-shipment review, in-transit monitoring and post-arrival traceability, improving port safety and customs clearance efficiency while standardizing global export operations for EU-bound cargo.

Exporters, manufacturers and freight forwarders must optimize operational procedures to adapt to the new rules. First, initiate ENS declaration at the booking stage and reserve sufficient review time to avoid last-minute submission. Second, ensure full data consistency across commercial invoices, packing lists, bills of lading and system declarations, avoiding abbreviations and incorrect parameters. Third, establish a pre-shipment review mechanism to verify MRN validity and manifest binding information.

Against the backdrop of peak shipping season with tight vessel space and volatile schedules, the mandatory ICS2 enforcement brings higher uncertainty to EU-bound logistics. All supply chain participants are advised to attach great importance to this compliance upgrade, abandon irregular traditional operations, and implement standardized pre-shipment risk control to avoid penalties and delays, ensuring stable and efficient cross-border logistics operations between China and Europe.
