On May 1, 2026, the "Hazardous Chemical Safety Law of the People's Republic of China" (hereinafter referred to as the "Hazardous Chemical Safety Law") officially came into effect. This law, consisting of 10 chapters and 127 articles, is the first fundamental and comprehensive regulation in the field of hazardous chemical safety in China, covering the entire production, storage, operation, and transportation chain, thoroughly regulating industry regulatory standards, and is crucial for the compliant operation of all hazardous material related practitioners.

Previously, the supervision of hazardous chemicals relied on various special regulations, which led to problems such as inconsistent standards and unclear responsibilities. This new law has achieved a unified supervision, clarified the responsibilities of all parties, increased the punishment for illegal activities, and marked a new stage of legal and standardized management of hazardous chemicals in China. For dangerous goods logistics, freight forwarders, and shippers, the new regulations are not multiple-choice questions, but mandatory courses that must be strictly followed. Violations will face high fines, production and business suspensions, and even criminal liability.
The transportation process is a key regulatory focus, and core compliance requirements must be kept in mind: firstly, the qualification for transportation must be entrusted to enterprises with corresponding licenses, and unlicensed transportation will result in a fine of 200000 to 300000 yuan; Secondly, personnel qualifications require drivers, escorts, and other personnel to hold certificates and undergo regular training; Thirdly, transportation vehicles must comply with safety standards, hang warning signs, and operate satellite positioning devices normally. Violations will result in a fine of 50000 to 100000 yuan; Fourthly, during the transportation process, highly toxic and explosive hazardous chemicals need to obtain a permit, implement escort and reporting systems during transportation, and strictly prohibit the transportation of highly toxic and hazardous chemicals in closed inland waters.
The new law clarifies the full chain responsibility: enterprises need to implement their main responsibilities, establish safety management systems and emergency mechanisms; Emergency management, transportation, public security, ecological environment and other departments collaborate to supervise and perform their respective duties; Employees are required to operate in a standardized manner, and those who violate regulations and cause accidents will be held criminally responsible. At the same time, the three supporting regulations are being implemented simultaneously and require simultaneous attention to avoid omissions.
The implementation of the new law will raise the compliance threshold of the industry, eliminate non compliant entities, and promote the transformation of the industry towards specialization and scale.
